1. Who we are

These Terms & Conditions ("Terms") govern your use of the GetHydrately app and website (the "Service"), provided by GetHydrately, trading as "GetHydrately" ("GetHydrately", "we", "us"). By using the Service you enter into a contract with GetHydrately on these Terms.

2. Acceptance

By creating an account, accessing, or continuing to use the Service, you confirm that you have read and agree to these Terms. If you do not agree, do not use the Service. You must be of legal age in your jurisdiction, and if you accept on behalf of an organisation, you confirm you have authority to bind it.

3. The service

GetHydrately is a water-tracking and reminder application that helps you log daily hydration, set goals, and build streaks. Some features ("GetHydrately Pro") are only available with an active subscription or lifetime purchase.

4. Acceptable use

You agree not to misuse the Service. In particular you must not:

  • use the Service for any unlawful purpose or in violation of any applicable law;
  • commit fraud, send spam, or impersonate any person or entity;
  • infringe the intellectual property or privacy rights of others;
  • interfere with or attempt to compromise the security of the Service, including by introducing malware, probing for vulnerabilities, or scraping at scale;
  • resell, redistribute, reverse engineer, or circumvent the technical limits of the Service.

4a. Safe hydration & health disclaimer

GetHydrately is a tracking and reminder tool. It is not medical advice, diagnosis, or treatment. You are solely responsible for how much water you drink. You agree to:

  • Not abuse hydration. Do not drink water in dangerous quantities. Excessive water intake can cause water intoxication (hyponatremia), which can be serious or fatal.
  • Not exceed safe daily limits. Follow the guidance of a qualified healthcare professional, especially if you are pregnant, have kidney, heart or hormonal conditions, are an endurance athlete, or take medication that affects fluid balance.
  • Not treat goals as prescriptions. The daily targets, streaks, XP, leagues, and notifications are gamified motivation — not medical instructions. Ignore them whenever your body, your doctor, or common sense says to stop.
  • Stop and seek help if you experience nausea, headache, confusion, swelling, or any symptom you suspect is related to over-hydration.

To the fullest extent permitted by law, GetHydrately, its owners, employees, and contributors are not liable for any injury, illness, hospitalization, disability, or death resulting from your hydration choices, your reliance on the app, missed reminders, inaccurate goals, or any third-party content shown inside the Service.

4c. Anti-cheat, fair play & leaderboards

Streaks, XP, leagues, badges, and verified status are awarded for genuine, human use of the Service. You must not:

  • log water you did not actually drink, or otherwise falsify entries to climb the leaderboard;
  • use bots, scripts, multi-accounts, emulators, or any automation to inflate progress;
  • buy, sell, trade, or transfer accounts, verified badges, or in-app status;
  • exploit bugs in scoring, payments, referrals, or rankings instead of reporting them.

We may reset XP, remove badges (including paid verified badges, without refund), wipe leaderboard positions, or permanently ban offending accounts.

5. Account and credentials

You are responsible for safeguarding your account credentials and for any activity that occurs under your account. You agree to provide accurate information and to keep it up to date.

6. Payments and subscriptions

Our order process is conducted by our online reseller Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. Lemon Squeezy provides all customer service enquiries and handles returns. Payment, billing, applicable taxes, currency conversion, cancellations, and refunds are governed by Lemon Squeezy's Terms of Service.

Subscription plans (monthly and yearly) renew automatically at the then-current price until cancelled. You can cancel at any time through the customer portal; cancellation takes effect at the end of the current billing period. The lifetime purchase is a one-time payment that grants access to Pro features for the lifetime of the Service.

7. Intellectual property

The Service, including its software, source code, design, branding, name, logo, gradients, sounds, animations, copy, and all other content, is the exclusive property of GetHydrately and is protected by Albanian and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to use the Service for personal, non-commercial use within the plan you have purchased. All other rights are reserved.

You must not copy, clone, mirror, fork, decompile, reverse engineer, or create derivative works of the Service, nor train any machine-learning model on GetHydrately content without our prior written consent.

8. Your content

You retain ownership of the underlying personal data you submit (e.g. hydration entries, settings, profile information). However, by creating an account and by posting any content inside GetHydrately (including usernames, avatars, bios, posts, comments, chat messages, leaderboard entries, and referral activity) you grant GetHydrately a worldwide, royalty-free, perpetual, irrevocable, sublicensable, transferable licence to host, store, reproduce, modify, adapt, translate, publish, display, and distribute that content for the purpose of operating, promoting, securing, and improving the Service.

Account ownership. The GetHydrately account itself — including the username, the verified badge, the XP, the league standing, the streaks, the referral graph, and any cosmetic status — is granted to you under a personal licence and remains the property of GetHydrately You have no right to sell, rent, lease, or transfer your account. We retain full administrative rights over every account, including the right to rename, merge, suspend, or delete accounts as needed to operate the Service or to comply with the law.

8a. Indemnity

You agree to defend, indemnify, and hold harmless GetHydrately, its officers, employees, contractors, and partners from and against any claim, demand, loss, damage, cost, or expense (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) your breach of these Terms; (c) content you submit to the Service; (d) your violation of any law or third-party right; or (e) any health consequence of your hydration choices.

9. Service availability and warranties

The Service is provided "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service in any 12-month period is limited to the fees you paid us during that period. We are not liable for indirect, incidental, special, or consequential damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability that cannot lawfully be excluded.

11. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay applicable fees, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time. On termination, your right to use the Service ends; we may delete your data after a reasonable period.

12. Changes to the service or these terms

We may update the Service and these Terms from time to time. Material changes will be notified through the Service or by email where appropriate. Continued use after changes take effect constitutes acceptance.
